ABOUT US Films Garden Pvt Ltd, through its platform “Rasmalai App”, is a free-to-air and premium video-on-demand platform bringing you amazing shows, movies, and exquisite content anywhere and anytime. (“We/Us/Rasmalai App”) The application is a premium advertisement-supported service. We feature content across numerous genres, including horror, drama, thriller, action, comedy, and more, tailored for diverse audiences with varying preferences. TERMS AND CONDITIONS User Agreement Films Garden Pvt Ltd, having its registered office at A-601, 6th Floor, Range Heights CHS Ltd, Goregaon Link Road, Jogeshwari West, Mumbai, Maharashtra - 400102, owns and operates the “Over The Top” (OTT) on-demand digital application and services under the brand name 'Rasmalai App'. This user agreement (“User Agreement”) shall be read in conjunction with the Privacy Policy, forming an integral part of the agreement between Rasmalai App and you (“User”, “You” or “Your”). Your access to the Services, including Subscription Services, constitutes your agreement to be bound by these terms. This is an “electronic record” under the Information Technology Act, 2000. We reserve the right to modify this User Agreement at any time without prior notice. 1. Terms of Use This agreement governs your access to all features, branding, data, text, images, and audio-visual content (series, movies, etc.) on the Rasmalai App. The Service is available only to Users above the age of 18 years. Use of third-party APIs (like YouTube) within our products implies your agreement to their respective Terms of Service as well. 2. Service Usage Terms You may use the Services only if you can form a binding contract with Films Garden Pvt Ltd. Services are evolving and may change or stop without prior notice. Content may be available: (a) free of charge with ads, (b) via subscription fee, (c) pay-per-view, or (d) a combination thereof. 3. Service Content and Third-Party Content In addition to original Rasmalai App content, we host Third-Party Content (including ads) on an "as is" basis. Films Garden Pvt Ltd acts purely as an "Intermediary" under the Information Technology Act, 2000, and holds no liability for Third-Party Content regarding intellectual property or defamation. 4. Subscription Services Premium content marked as "Rasmalai Premium" is accessible only to Subscription Users. To become a subscriber, you must create an Account using verified mobile numbers or social media credentials. 4A. Subscription Fee and Term Subscription Fees are inclusive of applicable taxes and must be paid through approved Payment Methods (App Store/Play Store/Gateways). The subscription is applicable for the specified period (Monthly/Quarterly/Yearly). Fees are non-refundable once the service has commenced. 4B. Billing, Payment, and Cancellation Subscriptions auto-renew unless cancelled through the "Account" section. We do not collect or store financial data like credit card numbers or OTPs; these are handled by third-party gateways (e.g., Zwitch). Films Garden Pvt Ltd is not liable for any losses due to third-party banking frauds. 5. Refund & Cancellation Policy As Rasmalai App provides non-tangible, irrevocable digital goods, we do not issue refunds once the subscription is activated. Cancellation: You may cancel at any time, and access will continue until the end of your current billing cycle. Exceptions: Refunds are only processed in cases of accidental duplicate payments or verified technical failures preventing access for more than 48 hours, subject to confirmation from our payment partners. 6. Intellectual Property Rights "Intellectual Property Rights" include all patents, trademarks, and copyrights owned by Films Garden Pvt Ltd and its licensors. You are granted a personal, non-exclusive, non-transferable license to view content for personal use only. You shall not copy, reverse-engineer, or commercially exploit any part of the Rasmalai App. 7. Conditions and Restrictions You agree not to: (i) tamper with non-public areas of the service; (ii) circumvent security or geo-filtering (VPNs); (iii) use automated means to scrape content; or (iv) interfere with the access of other users. 8. Indemnity You agree to indemnify and hold harmless Films Garden Pvt Ltd, its directors (including Pranshu Tiwari and Surendra Nath Pandey), and employees from any claims or losses resulting from your violation of this agreement or third-party rights. 9. Copyright Policy If you believe any content on the Rasmalai App infringes your copyright, please send a written notice to our Grievance Officer with identification of the work and your contact details. 10. Disclaimers and Limitation of Liability The services are provided "AS-IS." Films Garden Pvt Ltd disclaims all warranties regarding accuracy, availability, or security. To the maximum extent permitted by law, we shall not be liable for any indirect or incidental damages resulting from your use of the app. 11. Controlling Law and Jurisdiction This User Agreement is governed by the laws of India. All disputes arising shall be subject to the exclusive jurisdiction of the courts in Mumbai, India. 12.
